Judge Rules on Social Security: Are Benefits Considered Income?

As reported by Newsweek in the article “Social Security Update as Judge Rules About Benefits Being Income”, the Colorado Court of Appeals recently made a groundbreaking ruling: Social Security benefits can be used in alimony payments between divorced spouses.

This decision marks the first time a U.S. court has explicitly ruled that federal Social Security funds may be considered part of a spousal support (alimony) order. Traditionally, Social Security benefits have been protected under federal law as non-transferable and non-assignable, meaning they could not be redirected or withheld for obligations like alimony or child support.
